Perhaps it might be akin to courts ruling that students couldn't be prohibited from getting any tattoos that they wanted, but NASA saying that anyone who ever had a tattoo could not become an astronaut.

If someone was dead set on becoming an astronaut they would likely think twice before getting a tattoo, even if no one could prohibit them from doing so.

In this case, though, I wouldn't be surprised if someone could successfully challenge such an action by the NFL.
