The NFL/Players Union Collective Bargining Agreement can cover this issue and, in my opinion, impose some kind of "penalty" or "requirement" regarding high school NIL's on kids going into college or into the pros.
Clearly, I would expect Congress could enact a broader and more sweeping restriction than could probably be crafted as
part of the NFL/Players Union Collective Bargaining Agreement.
I suspect the applicable provision would be one in which the NFL players would agree that players who had received NIL payments in high school could not sign with NFL teams or something similar.
Banning a player from signing with the NFL is a fairly draconion measure. It would certainly be challenged in court and I'm not certain it would withstand the challenge.
