Dept of Education and every state constitution has an amendment recognizing public education.

There is absolutely no need for a federal DoE. There is not a mandate for education in the US Constitution and if Congress passes laws or funding for education, there is no need for the current middle man. Send the funds straight to the states.

Elimination of the federal DoE would effectively neuter the power of the teacher unions. Congress and the DoE gives them one-stop shopping for greasing palms and getting kickbacks. That would be very difficult to repeat with 50 different state DoEs.
