going to kill me, then I have the right to disarm you and take away your gun (property). For that matter, if you merely say to me "I'm going to take my gun out of my holster and shoot you", then I have the right to take it away from you. As does any police officer who happens to be there. Don't have to wait till the hammer has struck the firing pin.
