Overt act is a subjective determination, "crime" is subject to change based on political expediencies of the day, and an impartial court is a myth.

No reasonable person should ever want their rights subject to that process, even if the process is played out and considered due process.

On your example about the BB gun, that would capture many mischievous kids who would never shoot up an entire school.
