In a state where open carry is allowed, a heavily armed man is observed by the police approaching the house of a Supreme Court justice in the middle of the night. When detained and questioned, he admits that his intention was to break into the house and kill the justice and his family. But he has committed no crime, merely said that he intended to commit one. That is likely not grounds on its own for locking him up. But a red flag law would allow the court to order that his guns be confiscated, which under that factual scenario, they should be, and that the incident be noted on his record, which would prevent him from lawfully purchasing any other guns.
