Let's say two multi-billionaire boosters get into a bidding war over the #1 prospect... a once-in-a-generation type player that each billionaire is absolutely determined to get. They're passionate fans, so it's not about the money, it's about their team winning, so they're willing to bid whatever it takes. The mega-billionaires make counter-bids until one of them finally wins the auction at $100 MILLION.
The player & billionaire could *claim* it's for NIL-related services, but any reasonable person would know it's pay-for-play, not legitimate NIL protected by state law.
In less obvious cases, a compliance/oversight board would need to review and determine whether or not a deal is legitimate.
