I wouldn't go as far as saying "FMV of an NIL deal is whatever the offer is."
I get your point that FMV is hard to estimate and speculation about a prospect's *future value* makes it even fuzzier, but IMO a "reasonable person standard" still applies.
In other words, you can't offer an amount that's clearly unrealistic and beyond the potential/speculative future value of the NIL rights... an amount that any reasonable person would consider pay-for-play rather than a legit NIL deal/investment.
