well above the FMV of the NIL service, then it's clearly not just compensation for the NIL but also pay-for-play.

Its like Hunter Biden selling his finger-paintings for $500K each. Valuation of art is somewhat subjective, but at a certain point (price) a reasonable person would conclude that the payment is for more than just the "art" (in Hunter's case, influence pedaling).
