I trust you recall the case. Ed O'Bannon was the lead plaintiff in a class action lawsuit against the NCAA and various video game makers.
The NCAA was selling game footage to various game makers for use in video games and not compensating the former players who could appeared in the footage.
The Plaintiffs won at both the District Court and in the Ninth Circuit Court of Appeals.
It's settled law that the players own their image rights.
Further, the recently enacted California statute giving players the right to sell their image rights clearly is based and recognizes the basic principal that a player owns and can sell his personal image rights.
