1. A player’s NIL rights are a player’s personal property. That’s been determined by the Federal Courts.
2. The various state statutes allow each individual player to sell his or her NIL. The school has no right to the NIL rights.
3. There is no mechanism to transfer individual NIL rights to the a school, conference or NCAA.
4. Any deal for a school, a conference or the NCAA would require the consent of the players. The school, conferences & NCAA do not have the legal authority to “require” the players to pay some or all of proceeds from NIL sales be paid to the NCAA.
5. Trying to impose this on college players will just add fuel to the fire that schools, etc are “exploiting” the kids and strengthen the argument for revenue sharing with the players.
6. The sales of individual transactions. A system would have to be developed to collect the fees on each individual transaction, etc.
