Citizens of other countries that ARE ON US soil ARE subject to all governmental authority (a foreign citizen on a student or work visa, does not have the same sovereignty that a Native American does.) An illegal that sneaks across the border does not have the same sovereignty that a Native American has.
THIS IS WHY THE WORDING OF THE 14TH AMENDMENT IS RELEVANT. If Congress intent (on the enactment of the 14th was to exclude citizens of other countries, they should have worded it differently. If Congress did not SCOTUS decisions, they've had ample opportunities to amend.
