I am happy to answer, even though you declined to answer if Incarceration is a violation of the right to liberty.
The right to life may be negated or taken… In the cases of extreme cruelty in capital murder. I am very much for capital punishment as it tends to significantly reduce recidivism.
However, safeguards should be there especially regarding DNA evidence. I am not certain whether to advocate that DNA evidence must be required in all capital murder cases but I believe it should be gotten whenever possible.
Someone may be deprived of his life if he is trying to take mine, for example. I am not going to try and talk him out of it, I am not going to try and understand him. I'm going to shoot him in the flucking head. Probably several times.
The right to life is often taken justifiably during war. Wars aren't pretty and should be avoided, but when launched, people will die.
I believe property may be rightfully confiscated if it was acquired illegally.
Or taxes have not been paid you may forfeit your home. If car payments have not been made, you may forfeit your car.
Intellectual property is an area in which I am not particularly well-versed and I don't know how that is decided, adjudicated, amended, or resolved.
Jails and prisons are examples how someone's right to liberty may be justifiably rescinded. People who commit crimes should not be free to walk the streets, depending on the crime.
Liberty is often deprived for people who are legally insane. And liberty needs to be defined better here, in my opinion. Does liberty include the right to travel? Does it include the right to travel if you have a contagious deadly disease? Does liberty include the right to enter someone's house without their permission? Does liberty allow for someone to shjt on the sidewalk? Those issues and those answers are provided by government laws and regulations. Unicorns do not get to make them up as they go.
Liberty has limits in my opinion, they must be determined before liberty can be granted and we let anyone decide what the extent of their own liberties are.
In my opinion, there is overwhelming evidence that our rights come from our government. If you suggest otherwise, you will have your liberty taken away if you attempt to suggest that your rights as you understand them permit your actions.
I believe I have given my opinion honestly and accurately to the questions you asked. Now, look for ashtray and swamprat to respond with snarky, adolescent sniping from the sidelines. Without ever engaging in the conversation.
By the way, I still await your opinion on whether incarceration should be used since it deprives someone liberty.
