Correct, you make it on the plain meaning of the Constitution and in the rare instance of an ambiguity, you look to the notes and records of those who drafted and ratified the words.

Courts exercising judicial review is extraconstitutional. So, yeah, that's not how it's intended to work. That would be another example of casting aside the Constitution.
