who do not benefit from, and quite honestly who are expected to, demonstrate discretion. If my company has a strict no time off policy over a busy time, but one of my people calls and tells me her husband had a massive heart attack, it would be foolish of me to tell her to come to work or lose her job.

As a parent, if I tell my children they cannot drive with friends at night, but while spending the night with a friend his friend cuts his hand at midnight and he drives him to the ER, I am not going to punish him.

Most laws are about removing dangers and hazards to life and property. Police, prosecutors, judges, juries, etc. all make decisions based on such factors. And that does not damage order. That actually enhances the order of a society as discretion is a critical human trait.
