Jaywalking laws are less and less prevalent for just that reason. This is the nature of laws. You cannot ever get them perfect as you attempt to address dangers to life and property. Over time they will evolve and laws will be changed or amended to get them closer. But discretion will always be a key to maintaining law and order.
