My firing would not be a crime until it hit someone? Sorry man, that’s crazy. I would have to make conscious decisions to bring a weapon to a crowded area, make sure it’s loaded, then discharge it. That equates to making a conscious decision to ingest any substance that impairs judgement, reflexes, senses and getting behind the wheel of a vehicle.
There is always inherent risk when driving to be distracted by the sun, a deer beside the road, the cookie in your hand. Can these cause unfortunate accidents? Sure, but not the same thing as driving impaired.
