where someone is in a car but it's not moving. But this one is not even close. He's in a line to get fast food.

You can't get in a line without driving, right? There are multiple witnesses who can easily testify they saw him driving in the line immediately before the incident. That's all it takes, you don't have to complete a Nascar race.
