brought before it. The scope of the power of the executive branch is limited by the laws written by Congress. Laws written by Congress are subject to judicial review to determine whether or not they violate the Constitution.
The judiciary also has the power to determine if the executive is acting within the bounds of the laws written by Congress.
This check is to prevent the executive from exceeding its powers.
The judicial cannot be imperial as it has no law making and no actual enforcement power.
Congress cannot be imperial as it also has no actual enforcement power.
Only the executive is armed and can become imperial.
ACB made a stupid argument.
