Second, who knows what Penny knew about Neely, other than that many people knew about Neely's past erratic and threatening behavior.
Third, and most importantly, for those who were not on the train (i.e. prosecutors, judges, and juries), the long history of erratic behavior is good proof that the people who were actually there (i.e. Penny, the other Samaritans, and the other riders who thanked Penny and the other Samaritans) are not bull****ting when they say that the guy was striking legitimate fear into those aboard.
