Explain why others on the train felt they were in danger. If Neely had a known history of being peaceful and passive and no others felt threatened, that would be an important factor against Penny. In this case he was exhibiting a level of behavior that had turned physically violent in the past which would explain to authorities and or a jury why others on the train probably had good reason to be very concerned.
