Congress passed the Controlled Substances Act, which essentially *limits* the freedoms of Americans, regardless of what a state's law might be. (I.e., if a state made it legal to deal in or possess a particular drug, it's still *illegal* to do so federally). The constitutionality of such law if it's been challenged, it hasn't much been discussed.
If that's the case then certainly Congress could pass a federal law which essentially *protects* the freedoms of Americans, regardless of what a state's law might be.
And even if it were to be found unconstitutional, it would take a bit of time for *that* lawsuit to work its way through the system, right?
