and his job is not to interpret the Prosecution's "motivation" in bringing the case. When prosecutors are political animals because they have to get re-elected, motivations may be "distasteful" all the time.

His job is to run the trial. Make sure that both sides are operating within the rules and that the case is processed through the system according to those rules. Anything more is bias/judicial activism which you guys decry all the time.
