compete for one of its sports teams – court decisions in similar cases have indicated that they would be allowed to do so.
They could argue that the NCAA is a collusion between universities to hinder the free markets. That argument has been successful in other eligibility challenges (e.g. pro vs amateur), so why not this?
It seems logical to only allow students to compete on the teams, but the courts consider the law (e.g. antitrust statutes) rather than what's logical. That's why college sports is currently such a mess.
