The NIL entity enters contracts with athletes on the basis of promises from the donors. Maybe they only do an NIL deal with cash up front from the donor. But what if to keep up, they get a pledge from a donor for so much each year? What if a donor hits hard times, changes their minds, gets sued by the SEC/IRS, whatever, etc.
I assume the donations funding the NIL contracts are themselves a matter of contract between the NIL entity and the donors.
There is a myriad of ways for this thing to go sideways.
It will be interesting to see.
