A state could pass a law that legalizes flat-out pay-for-play bribes (with no pretense of "NIL" attached) to gain an advantage over the other states (until the rest follow suit in an arms race, of course).
That doesn't mean it's within the rules. The NCAA could still sanction the school, which the school would then have to challenge in court.
