More importantly, did modern Congresses realize that the realities of modern warfare were very different than those in the 1800s and thus abdicate some of their authority to the executive branch through the war powers acts?
We can argue the constitutionality of that but since the courts have never been pressed to rule on it for the time we must assume that it is constitutional.
