to mean less traditional warfare, not between two sovereigns (or more) but between a sovereign or several sovereigns against a group taking up arms in furtherance of religious ideology or intolerance. ISIS / Al-Qaeda / Iraqui Sectarianism.

We've also resorted to skirmish fighting in most cases, also not traditional warfare.

I'm not sure how you bridge the gap in reality versus what the Constitution requires, but there is a gap for sure.
