to which I agree, the idea , quite obviously, is that the hyper partisan hacks get weeded out- as they shouldn't be there in the first place.

You bring up a great point. judges should judge based on the law, not some partisan hacky legislating from the bench- so you are defending the very wrong I seek to address.
And if it requires and amendment- then it requires and amendment, its what amendments are for
