as it relates to a Congressional investigation is obstruction. A court can decide if a subpoena is quashed, but the subpoenaed party has to file a motion to quash.
Under your system, the party issuing the subpoena has to do so apparently and that is just plain wrong. Again, no surprise.
But you don't get to just sit on a subpoena without a court order quashing the motion.
