14th amendment to the Constitution incorporated the Bill of Rights, requiring the states to protect the rights of the citizens as delineated in the Bill of Rights.
In Gitlow v. New York, the Court expressly held that States were bound to protect freedom of speech.
Of course you may feel that the Supreme Court interpreted the constitution wrongly, as it did in Roe v Wade, and perhaps they have, but from my point of view we should play by the rules as given to us until we can get them changed.
If a coach felt the game would be better if defenders didn't hit the receivers early on and therefore instructed his players not to do so, he would put his team at a disadvantage in games if the other teams are doing that to his team.
