punishment was necessary, unless she has had a record of bad behavior.
If a seven-year-old white boy had written "all the flucking nigggers should die" would that be OK?
If someone (except for camel jockeys, of course) had written "death to the flucking Jews" would that be ok?
If the school has rules and regulations about what may or may not be said or written, the kid cannot claim First Amendment rights and say that she's too young to follow the rules.
To be clear, it's not a question of when First Amendment rights kick in. It's a question of following the rules in the school. If the school rules are that you may not call your teacher a stupid flucking bltch, that kid should be punished.
It has nothing to do with first amendment rights.
