I am a criminal defense attorney and former prosecutor. I routinely am of the opinion that my clients are entitled to a lower bond or a ‘recognizance’ bond. I had several clients held on “$50,000 Cash Only” bonds that I thought were wildly inappropriate. That same client in a neighboring county might get a $5000 surety (bondsman) bond and be out the same day.
Each jurisdiction has its own bond policies, some of which I agree with some of which I don’t. The system is weighted against the poor to be sure.
As to the J6 defendants I would have to look at each on a case by case basis. Each has different facts, different criminal histories, and different flight risks to say nothing of different judges. Are some held unfairly? Maybe. Maybe holding some of them in jail before trial best serves the public interest.
Bail reform is a major concern nationwide. It should continue to be addressed and improved upon.
