Everything can (and has) been argued to present safety issues. Have you not heard that racism is a public health issue? Your same argument could be used to justify not hiring whites on the basis of this public health issue, and that not hiring whites is for safety reasons.

The proper way to frame it is rights. Employers have rights to set conditions of employment, regardless of safety.
