the difference of course is in how much pressure I applied and in the case of the example where I killed you there would undoubtedly be evidence of MECHANICAL asphyxiation.
the state has no evidence of mechanical asphyxiation.
what we do have is evidence that Floyd had 3x the lethal limit of fentanyl in his system along with meth, a crazy bad heart condition, oh and covid too.
they have evidence of him saying he couldn't breathe before he was ever proned out on the ground.
they have evidence of him foaming at the mouth before being proned out indicative of a respiratory issue caused by fentanyl.
Not to mention there are plenty of still images of the knee to the "neck" and he's clearly on the shoulder blade. So the perspective of the bystanders' videos is somewhat misleading at minimum for some of the time.
now all that being said, I think what Chauvin did is dumb. in my experience I have no idea why, for example, they ever tried to put him in the patrol car. they should have recognized he was in some sort of distress, whether real or feigned, and they should have just got him cuffed and set him down on the curb or sidewalk and called an ambulance.
but that negligence certainly doesn't equate to murder and maybe not even manslaughter. but it's most clearly not ABSURD to suggest the drugs, not the knee, killed Floyd. That gets to the heart of the state's responsibility of proving BEYOND a reasonable doubt that Chauvin killed him. You don't have to believe he's necessarily innocent but if you have some doubt about the knee vs drugs then you must acquit.
btw interesting hypothetical for you. You have two choices:
1. take a 3x lethal amount of fentanyl OR
2. have 140 pound P.O. Chauvin kneel on your neck
which would you choose and why?
