To answer your asinine question of why don't we assume laws are unconstitutional. That would require that every single law that was passed be put on hold until our judicial system could hold a hearing to determine their constitutionality. That would delay the system by sometimes years when only a very small percentage of laws are ever deemed unconstitutional.
So the reason we don't do it that way is because it is a stupid idea.
