The founders understood that there needed to be a check on the legislative and executive branches because they could be swayed by public opinion that may not always align with our Constitution.

But if the law is passed by the legislature and signed by the governor then yes it would be assumed to be Constitutional until the courts ruled otherwise.

What is the difficulty with this concept for you?
