He didn't say anything about possession.

I said that "if there are no legal consequences for doing so one could also say that functionally it is legal".

Is that not true? If a cop saw someone snort a line of coke could s/he arrest that person even if they had none in their possession? Or would someone face legal consequences if coke was detected in their system?
