I agree. I do think there can be aggravating circumstances

that make a crime more egregious & hence worthy of a stiffer penalty, but don't think the "hate crime" categories they came up with to be a reasonable or fair way of doing so.
For instance, I think that there is a difference between some kids burning a little pile of wood on a neighbor's yard is a different level of crime than burning a cross as a means of intimidation of a black family à la the KKK.
But having specially designated "protected classes" is a dangerous way to move forward.
