I doubt you'd separate a family for jaywalking, but domestic terrorism certainly would seem to be serious enough to justify it.
As for illegally entering the country - it would seem to me that you have to determine asylum seekers from those illegally entering. And even if you limit it to illegal entrants, why wouldn't you want to keep them all together so you can send them back en masse?
