The answer to your question is: yes, under the Constitution, any one accused of a crime by the U.S. govt shall be afforded due process of law, the right to effective counsel, the right to be confronted by witnesses, the right to a speedy trial, and the right to a trial by jury (among other "rights").
But, of course, this does not happen in practice
