yes, you have the right to use force against the trespasser; he is infringing upon your rights. whether you choose to do so or not is up to you, but you have the right.
the law is irrelevant because we are talking about rights, not law. i don't really care what reason you give for "seeking the authorities". it has no bearing to what i said previously regarding rights and consent. that said, there are two issues here: one is that the State hs infringed upon us and conditioned us so much to believe we are not to rely on ourselves, that it is the great protector, and to disarm us (because self-defense is an affirmation of self-ownership) that it has created the "personal injury" climate. second, personal injury claim could still come about in an anarcho-capitalist society, though i doubt it would get much traction.
