Courts have made that up as part of their responsibility. And they don't only get involved when someone gets them involved. They got involved in this because they want to get involved. Courts can dismiss any case for which they do not have jurisdiction, which is what they should have done in this case. They have no role to play in running college athletics, except to maybe enforce Title IX which they have obviously failed to do for some reason. Now Title IX is a case they should be involved in because it is an Act of Congress that has been ignored. They have no role in making up rights that do not exist outside of something Congress has passed as a law. Period.
