Now the judges have the right to ignore the governmental agency in charge of that area, and make their own decisions. Note this is only applicable in those grey areas where the written law is not clear. So judges are making the rules in those instances instead of the agency tasked with oversight of that area. Jusges that may lean one way or another. Judges that may or may not have any idea of that topic. And judges that could soon be overruled by another higher court. And that is the biggest problem. Business wants certainty. So they can plan, invest, build, know what the rules are. Now the rules can much more easily change at any time. A business could be doing all they can to comply with the rules, then a court makes a ruling that changes those rules, and the business has to change along with it. This is much more likely to happen much more often now that Chevron is gone. Most businesses wanted Chevron, because they want consistency in the rules, just like batters and pitchers want consistency from an umpire more than anything else.
