that is why Chevron worked so well. You werent asking judges to rule on anything other than the law. Now they have expert testimony, but most people don't expect a judge, even after expert testimony, to be able to understand everything they need to know about the complexities of the individual cases. So ot was left to governmental agencies to fillin the grey areas. Not major issues, but the grey areas not filled in explicitely by the laws. Now businesses have a harder time planning for the future, because they have a lot less confidence that the rules will not change. Rules will be at the whims of individual judges who may or may not really and fully understand the issues. Most businesses liked Chevron. It gave them more certainty.
