How do you determine if someone is in the country illegally or not without due process? How do you determine if they have properly applied for asylum without due process? These are part of what due process is. You cant just assume the end result of due process before it has begun. Thats like saying you dont need to have a trial because someone is a murderer. How do you know he's a murderer? Well, we just decided he is. Thats why we don't need a trial. Makes absolutely no sense.
