The problem, as I see it, is increased border apprehensions, as shown here:

Current law allows asylum seekers to enter legally. That’s the law being enforced. Congress doesn’t allocate sufficient resources to process them efficiently.
Notice the major increase in 2019. The numbers were down significantly in 2020 - I believe due to COVID and Title 42. And then grew substantially again in 21 and 22 under Biden/Harris.
The problem that Congress can fix is:
1) current asylum law
2) insufficient resources
