Is it a federal right as identified by the Constitution?
Is it a state right as identified by a state's constitution?
Is it an imaginary natural right as defined by the resident idiot?
Many of those that you stated have been identified as Constitutional rights by one entity or another and therefore receive the backing and support of the government.
While the federal constitution is supposed to be somewhat limited in scope the state constitutions give almost unfettered power to the people in defining the 'rights' of that state.
At the state level, the discussion is more about whether should they be 'rights' as opposed to, are they.
