There are enumerated powers in the constitution and the rest are reserved for the states. First, to claim supremacy clause it has to be an enumerated power. Has the been abused greatly? Yes

Now for necessary and proper the same principle applies. The Federal government has no authority here and you cant cite it in the constitution. It isn't there. It was a court decision as I mentioned below. But even that court decision does not given Biden the power to do what he did with these kids
