The plain and simple truth is the framers never considered whether or not a woman has a right to an abortion and the Constitution is silent on the issue.
The Roe majority looked at all the individual rights granted by the Constitution and essentially reasoned if the framers had considered whether a woman has a right to abortion, they would have granted her that right because of all the other rights they granted to individuals. That may well be true, but they didn’t consider the issue.
The abortion rights movement has known for fifty years exactly what the court did. It has known for fifty years that it was relying on judge made law, not framers made law.
It has also known there are well establish procedures to amend the constitution. It has not pursued any of them. Yes, if it had there would have been oNe hell of an argument, but however it was resolved would have avoided what the country now faces.
If Liz Warren is going to cast aspersions on anyone it should be herself and her fellow liberals.
And frankly, a constitutional provision allowing abortions subject to reasonable regulation is probably an outcome, a resolution of this issue that neither side would like, but in time could learn to live with. The right to abortions would exist, but be subject to reasonable regulation and reasonable regulation could be litigated.
And if the Amendment gives a woman an absolute right to an abortion, I can live with that.
